South Dakota Legislative Update: Feb. 2

Latest actions in South Dakota Legislature on key bills

 

The South Dakota Legislature for 2006 meets between January 10 and February 28, returning again on March 20 for consideration of any gubernatorial vetos.  During this time, bills, resolutions and constitutional amendments affecting South Dakota will be considered by the state House and Senate, before those which have passed are referred to the governor for his signature, making law, or his veto.

 

Below is a summary of some of the more interesting bills, with the latest actions or pending actions for each.

To prohibit sex offenders from residing within a specified distance from certain places where children are present.

HB 1080 To restrict the use of eminent domain. Passed House 67-1.  Referred to Senate State Affairs committee.
HB 1086 To restrict the rights of certain sex offenders related to adoption or visitation of children. House passed 65-0.  Scheduled for Senate Judiciary committee 2/3/2006.
HB 1132 To terminate parental rights of persons convicted of rape or incest and to restrict access to the child. Deferred to 36th legislative day (i.e. killed) 11-1
HB 1134 To to revise certain provisions regarding the justifiable use of force. Judiciary passed 10-2.  House passed 48-19Referred to Senate Judiciary committee 2/2/2006.
HB 1153 To revise the definition of a prohibited sexual act, adding a specification. House passed 65-0Referred to Senate Judiciary committee 2/2/2006.
HB 1183 To provide health insurance coverage for contraceptive drugs and devices Commerce committee deferred to 36th legislative day (i.e. killed) 9-4.
HB 1194 To prohibit the distribution of contraceptives to public school students, to prohibit public school employees from referring public school students to abortion or family planning services Scheduled for House Education committee hearing 2/3/2006.
HB 1198 To require Department of Health inspections of abortion facilities Passed Health and Human Svcs 11-2.  House passede 65-2. Referred to Senate State Affairs committee.
HB 1202 To require health care providers to notify a parent/guardian if a minor is treated for a sexually transmitted disease (STD) Referred to 36th legislative day (i.e. killed) 8-5.
HB 1215 To reinstate the prohibition against certain acts causing the termination of an unborn human life. Referred to State Affairs committee 1/24/2006.
HB 1217 To provide for the clarification of sexual abstinence instruction Scheduled for committee hearing 2/3/2006.
HB 1234 To require all children to attend kindergarten Referred to Education committee 1/25/2006.
HB 1245 To provide for an increase in the state minimum wage. Deferred to 36th legislative day (i.e. killed) 9-3.
HCR 1004 Urging the voters of South Dakota to reject the Judicial Accountability Initiated Law (J.A.I.L.), which will be submitted to South Dakota voters in November 2006, designated Amendment E. House State Affairs committee pass 11-0House passed 67-0.
HJR 1004 To amend the Constitution of the State of South Dakota, imposing a corporate income tax Referred to State Affairs committee 1/20/2006.  Deferred to 36th legislative day (i.e. killed) 10-3
HJR 1005 To amend the Constitution of the State of South Dakota, limiting taxation to population and inflation. Referred to State Affairs committee 1/23/2006. State Affairs committee tabled 13-0
SB 1 To provide for the mandatory withdrawal of blood or other bodily substances subsequent to arrest for driving while under influence. Passed Senate 22-13.  Scheduled for committee hearing 2/3/2006.
SB 96 To exempt religious organizations from sales and use taxes Deferred to 36th legislative day (i.e. killed) 8-0
SB 99 To establish a task force to study sexual assault and to provide for its composition, scope, and administration. Passed Senate 33-1. Referred to House Judiciary committee 1/27/2006.
SB 102 To provide for the civil commitment of sexually violent predators. Referred to Senate Judiciary committee 1/19/2006.
SB 110 To require a court to determine whether a child is granted an excuse from school attendance under certain circumstances. Deferred to 36th legislative day (i.e. killed) in committee vote 4-3
SB 117 To establish the first day of the school year as the first Tuesday following the first Monday in September. Deferred to 36th legislative day by 5-1 committee vote (i.e. killed).
SB 140 To establish minimum sentencing and electronic monitoring requirements for certain sex offenders. Senate Judiciary committee tabled 5-0.
SB 141 To revise reporting requirements related to the registration and monitoring of sex offenders. Senate Judiciary committee tabled 5-0.
SB 148 To revise certain provisions regarding the sex offender registry and the supervision of sex offenders. Judiciary committee pass 7-0. Senate passed 35-0.  Referred to House Judiciary committee.
SB 150 To require the state's participation in the National Sex Offender Public Registry and to provide for the posting of a state internet sex registry site. Passed Senate 34-0. Referred to House Judiciary committee 1/27/2006
SB 175 To provide "Plan B" or "Morning After" pill to rape victims Health and Human Svc committee passed 4-3.  Senate failed 9-26.
SB 196 To require non-abstinence based sex ed in public schools. Introduced 1/24/2006.
SR 1 Supporting the nomination of Judge Samuel Alito to the Supreme Court of the United States. Passed Senate 25-9.
SJR 2 To amend the Constitution of the State of South Dakota, affirming that it is the policy of South Dakota is to protect the life of the unborn child from conception until birth Referred to State Affairs committee 1/23/2006.
